Welcome to Xinfer.AI. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.

1. Service Description

Xinfer.AI provides a platform that transforms your website content and product catalog into domain-expert AI assistants ("Service"). This includes:

  • Crawling and indexing your website content (guides, FAQs, policies)
  • Indexing your product or service catalog
  • Deploying AI-powered chatbots trained on your domain
  • Ongoing updates and maintenance of your AI assistant

2. Account Registration

To use our Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be at least 18 years old or have legal authority to bind your organization

You are responsible for all activities under your account.

3. Your Content and Data

3.1 Ownership

You retain all ownership rights to your content, including:

  • Website content we crawl on your behalf
  • Product catalogs and data you provide
  • Branding, logos, and domain-specific configurations

3.2 License to Xinfer.AI

By using our Service, you grant Xinfer.AI a limited, non-exclusive license to:

  • Access, crawl, and index your publicly available website content
  • Process and store your product catalog data
  • Use your content to power your AI assistant
  • Display your branding within your deployed chatbot

This license exists solely to provide the Service and terminates when you cancel your subscription.

3.3 Data Handling

  • Your content is used exclusively for your AI assistant deployment
  • We do not share your proprietary data with other customers
  • We do not use your content to train models for other parties

4. AI-Generated Content

4.1 Nature of AI Responses

Our AI assistants generate responses based on your provided content. You acknowledge that:

  • AI responses may occasionally be inaccurate or incomplete
  • AI assistants are tools to assist, not replace, human judgment
  • You are responsible for reviewing AI configurations for your use case

4.2 Your Responsibility

You are responsible for:

  • Ensuring your source content is accurate and up-to-date
  • Monitoring your AI assistant's responses for quality
  • Providing appropriate disclaimers to your end users
  • Compliance with industry-specific regulations in your domain

5. Subscription and Payment

5.1 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as specified in Section 5.3
  • Prices may change with 30 days notice

5.2 Auto-Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time through your account settings.

5.3 Refund Policy

  • New subscribers receive a 7-day trial period with full platform access
  • If unsatisfied during the trial, request a full refund
  • API usage and inference costs incurred during the trial are non-refundable
  • Post-trial refunds are evaluated on a case-by-case basis

6. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes or to promote harmful content
  • Attempt to reverse engineer, decompile, or extract our proprietary technology
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to build a competing product or service
  • Exceed usage limits or circumvent rate limiting
  • Misrepresent AI-generated responses as human-generated
  • Deploy AI assistants that provide medical, legal, or financial advice without appropriate disclaimers

7. Intellectual Property

7.1 Xinfer.AI Property

The platform, including its architecture, algorithms, interfaces, and documentation, is the exclusive property of Xinfer.AI. You receive no ownership rights to our technology.

7.2 Your Property

Your content, branding, and domain configurations remain your property. Upon termination, you may request export of your configurations.

8. Service Availability

8.1 Uptime

We strive for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

8.2 Modifications

We may modify, update, or discontinue features with reasonable notice. Material changes affecting your deployment will include migration assistance.

9. Limitation of Liability

9.1 Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

9.2 Limitation

To the maximum extent permitted by law, Xinfer.AI shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Actions taken by end users based on AI-generated responses
  • Inaccuracies in AI-generated content

Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Xinfer.AI from claims arising from:

  • Your content or its use within the Service
  • Your violation of these Terms
  • Your end users' interactions with your AI assistant
  • Your violation of applicable laws or regulations

11. Termination

11.1 By You

You may cancel your subscription at any time. Access continues until the end of your billing period.

11.2 By Xinfer.AI

We may suspend or terminate your access for:

  • Violation of these Terms
  • Non-payment of fees
  • Conduct harmful to other users or our infrastructure
  • Extended inactivity (with notice)

11.3 Effect of Termination

Upon termination:

  • Your AI assistant will be deactivated
  • Your data will be retained for 30 days for potential reactivation
  • After 30 days, your data will be permanently deleted
  • You may request data export before deletion

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the jurisdiction where Xinfer.AI is registered.

12.2 Resolution Process

Before filing any claim, you agree to attempt informal resolution by contacting us at legal@xinfer.ai. If unresolved after 30 days, disputes shall be resolved through binding arbitration.

13. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
